Served as coverage counsel in a declaratory judgment action against a subcontractor in North Carolina federal court regarding defective windows and sliding glass doors in a condominium development.

Served as coverage counsel in declaratory judgment actions in Virgin Islands federal court involving the “permissive user” coverage issue under business package policies.

Served as coverage counsel in a declaratory judgment action against our named insured, a HVAC supplier, in Illinois state court regarding the application of my client’s asbestos exclusions.

Served as coverage counsel in a declaratory judgment action against a property owner in Missouri federal court regarding damage and vandalism to a church closed due to foreclosure. After several years of contentious litigation, I negotiated a very favorable settlement for my client on the eve of trial.

Served as coverage counsel in a dispute where the named insured was sued for severe injuries, including death, at a construction site on the highway. The case was pending in St. Clair County, Illinois, nationally known as one of the “judicial hellholes” for defense counsel in the country. After several years of contentious litigation, I negotiated a very favorable settlement for my client.

Served as coverage counsel in an arbitration involving a motorcyclist injured allegedly due to uneven pavement after water pipe repairs in Missouri.

Served as coverage counsel in a mediation involving millions in cleanup costs for alleged environmental contamination at or near railroad depots. The mediator agreed with my client’s position thereby fostering a very nominal settlement.

Served as coverage counsel handling various bodily injury claims as a result of alleged formaldehyde exposure against several manufacturers of trailers used to house displaced victims of Hurricane Katrina.

Summary judgment and favorable appellate ruling in Ohio federal court involving alleged pollution at multiple manufacturing sites by a tire manufacturer. GenCorp v. AIU Ins. Co., 297 F. Supp. 2d 995 (N.D. Oh. 2003), aff’d 138 Fed. Appx. 732 (6th Cir. 2005).

Served as trial counsel in a jury trial in federal court in Detroit. The case was brought by a multi-national chemical manufacturer and involved more than $90 million in alleged damages. The case was favorably resolved for my client before verdict. Aetna Cas. & Sur. Co. v. Dow Chem. Co., 44 F. Supp. 2d 870 (E.D. Mich. 1999).

Served as coverage counsel in an environmental coverage case in Minnesota involving a Canadian manufacturer.

Represented insurance companies in a coverage dispute in Indiana with a manufacturing and processing conglomerate arising from environmental contamination claims throughout the country. I eventually negotiated a very favorable settlement for my client. P.R. Mallory & Co. v. Am. Cas. Co., Case No. 54C01-0005-CP-156 (Ind. Cir. Ct. 2009).

Represented an insurance company in a coverage dispute with a Fortune 50 chemical company involving bodily injury claims as a result of the use of its pesticide by various farmers throughout the country.

Represented an insurance company in a coverage dispute with an Illinois public utility company with respect to mercury spills in residences when the company’s electrical meters were replaced.

Represented an insurance company in a coverage dispute in Illinois circuit court with an electrical equipment manufacturer with respect to hundreds of asbestos-related bodily injury claims.

Represented an insurance company in a coverage dispute with a public electrical utility company that sought insurance coverage for its costs in investigating and remediating environmental contamination at the gas company’s manufactured gas plant sites located in Illinois. Northern Ill. Gas Co. v. Home Ins. Co., 334 Ill. App. 3d 38 (1st Dist. 2002).

Represented an insurance company in a coverage dispute in Iowa with a large manufacturer of premium windows with respect to a nationwide class action lawsuit arising from water infiltration claims.

Served as coverage counsel for an insurer of a developer accused of faulty construction of affordable housing units.
